These Terms of Use (the "Terms") govern your access and use of our Artificially Intelligent (the “AI”) powered platform that acts as a virtual employee and helps you to automate and enhance recruitment workflows for your company. Our AI Agents handle tasks such as sourcing, evaluating, outreach, scheduling, and more, reducing operational inefficiencies and cost and improving hiring outcomes. By using our Platform, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Platform.
Our platform acts as a virtual employee, automating, and optimizing recruitment workflows for businesses. By leveraging AI Agents, we streamline key recruiting tasks such as sourcing, evaluating Candidates, conducting outreach, scheduling interviews, and more.
Each task is executed by an AI Agent, an autonomous intelligent system that performs specific functions without human intervention. These AI-powered solutions serve as a virtual HR department, helping companies reduce operational inefficiencies and hiring costs and improve hiring outcomes by automating repetitive tasks (the "Services").
THE CURRENT VERSION OF OUR WEBSITE OPERATES IN BETA FORMAT AND IS OFFERED ON A TESTING, BETA, OR EARLY ACCESS BASIS (THE “TESTING FEATURES”). ANY FEEDBACK PROVIDED REGARDING THE TESTING FEATURES MAY BE USED TO ENHANCE AND IMPROVE THE SERVICE.
YOUR ACCESS TO AND USE OF TESTING FEATURES IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To access and use our Platform, Users must create an account and provide accurate and complete information for all Users under their business subscription (the “Authorized Users”).
Individuals. Users must be at least 18 years old to consent to and use the Services. You must provide accurate and complete information to register for an account to use our Services. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account.
Corporate Domains. If you create an account using an email address owned by an organization (e.g., your employer), that account may be added to the organization’s business account with us.

In order to access the Platform and use the Services, Users must comply with all applicable data protection regulations, including GDPR and CCPA, when handling Candidate Data.
All Outputs, or any other data provided to you during performance of the Services, other than Your Data is Our Date. You may not use Our Data in training or fine-tuning of any other AI-based products or models unless explicitly permitted.
By using our website or Services, you agree that Ogment may include your business name and logo in its customer lists, case studies, and earnings communications, unless you notify us otherwise. If you are an individual or sole proprietor, this use is subject to your consent under applicable privacy laws, and you may opt out at any time by contacting legal@ogment.ai.
Our Data access will be granted via secure database access, or other means defined by us. You must ensure compatibility with our systems and agree that:
For the Users located in the European Union, Your Data is stored in the European Union. For the Users located in the United States, Your Data is stored in the United States. You further acknowledge that processing of Your Data will still occur within the United States and/or the European Union.

You may provide input to the Services (the "Input") and receive output from the Services based on that input (the "Output"). You are responsible for the Input, including ensuring that it does not violate any applicable law or these Terms. Output may contain Your Data, Our Data, or any other third-party data. You represent and warrant that you have all rights, licenses, and permissions needed to provide Input to our Services.
Our Services include AI Agents that automate workflows, analyze data, and perform specific tasks on your behalf. These AI-driven systems operate using probabilistic algorithms, meaning that the results may not always be perfect or entirely error-free.
You acknowledge and agree that AI-generated Output should be reviewed and validated before reliance on it for any critical business or hiring decisions.
5.3. Similarity of Output
Due to the nature of our Services and AI generally, Output may not be unique, and other Users may receive similar output from our Services.
AI and machine learning are rapidly evolving fields of study. We are constantly working to improve our Services to make them more accurate, reliable, safe, and beneficial. Given the probabilistic nature of machine learning, use of our Services may, in some situations, result in Output that does not accurately reflect real people, places, or facts.
The AI-generated outputs provided by Ogment’s AI Agents are probabilistic and may not always be accurate, complete, or unbiased. The AI Services operate based on AI models, which means outputs may vary and should not be solely relied upon for hiring decisions. Ogment does not guarantee the accuracy or suitability of AI-generated recommendations. Customers must independently validate results before making any hiring or employment-related decisions.
You may not use our Services for:
Interfering with or disrupting our Services, including circumventing any rate limits or restrictions or bypassing any protective measures or safety mitigations we put on our Services.
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to use our Services for lawful purposes. The license does not grant any ownership rights and is limited to the following rights:
You may not sublicense our Services or data unless explicitly authorized by the Customer Rider. If sublicensing is permitted, you remain responsible for compliance with these Terms.
Our Services may include third-party software, products, data, or services (the “Third-Party Services”). Third-Party Services are subject to their own terms, and we are not responsible for them. We may use third-party data to provide the Output.
Provided that we have acted with professional diligence, we do not take responsibility for loss or damage caused by us, unless it is: caused by our breach of these Terms or reasonably foreseeable at the time of entering into these Terms. We do not take responsibility for loss or damage caused by events beyond our reasonable control. We do not exclude or limit our liability to you in any way where it would be unlawful for us to do so. You still have the full protections of the laws applicable to you.

Ogment provides AI-powered recruiting automation tools to assist with talent sourcing, evaluation, outreach, and scheduling. However, the final hiring decisions are made solely by the customer. Ogment is not responsible for any employment decisions, including but not limited to hiring, rejection, promotion, or termination based on AI-generated recommendations. The customer acknowledges that they bear full responsibility for verifying the accuracy, compliance, and suitability of candidates before making hiring decisions.
We commit to providing Services to you with reasonable skill and care and to acting with professional diligence. We do not promise to offer the Services forever or in their current form for any particular period of time.
Upon termination of your access to our Services, you must:

These Terms are governed by the laws of Delaware, without regard to conflict of law principles.
